Please read these Terms of Service ("Terms") carefully before using the https://higherhost.com website and WordPress hosting services (the "Service") operated by HigherHost ("us", "we", or "our").
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in termination of your account.
You are responsible for safeguarding your password and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Our Service provides hosting for WordPress websites. You agree to use the Service only for lawful purposes and in accordance with these Terms.
You are solely responsible for the content of your hosted website, including but not limited to text, images, products, and customer data. You agree not to use the Service to host any content that is illegal, offensive, infringes on third-party rights, or violates applicable laws.

We reserve the right to suspend or terminate accounts that violate these terms without refund.
We perform automatic backups (weekly for Starter plans, daily for Growth and Professional plans). However, you are responsible for maintaining your own backups of critical website content and data. We are not liable for data loss.
Each plan includes a monthly visitor allocation (Starter: 10,000, Growth: 25,000, Professional: 40,000). These limits are guidelines, not hard cutoffs.
Our Fair Use Policy:
We will not immediately suspend your site if you exceed your visitor limit. If your site consistently exceeds its allocation, we will contact you to discuss upgrading to a plan that fits your traffic. We believe in working with customers, not cutting them off without warning.
However, if traffic significantly and consistently exceeds your plan limits (for example, 2-3x your allocation for multiple months), we reserve the right to require an upgrade or apply overage fees.
Our hosting is designed for typical WordPress websites. Accounts that use excessive CPU, memory, or bandwidth in a way that affects other customers may be asked to optimize their site or upgrade to a higher plan.
Current pricing is listed on our website. All prices are in Euros (€) unless otherwise stated.

Growth: €17.99/month
Professional: €29.99/month
The price you sign up at is the price you will renew at for as long as you remain a continuous customer. We will not increase your renewal price.
We reserve the right to change pricing for new customers at any time. Price changes do not affect existing customers on active plans.
Payment is due at the start of each billing period. If payment fails, we will attempt to notify you. Accounts with failed payments may be suspended after 7 days and terminated after 30 days of non-payment.
We offer a 30-day money-back guarantee for new customers. If you are not satisfied within your first 30 days, contact us for a full refund. Refunds are not available after the 30-day period or for renewal payments.
We commit to 99.9% uptime for our hosting services, measured on a monthly basis.
Uptime is calculated as: ((Total minutes in month - Downtime minutes) / Total minutes in month) × 100
Example: A 30-day month has 43,200 minutes. 99.9% uptime allows for up to 43 minutes of downtime per month.
Downtime is measured as the time your website is completely inaccessible due to issues within our control (server failures, network issues on our end).
The following do NOT count as downtime:
If we fail to meet 99.9% uptime in any calendar month, you may request a credit of 5% of that month's hosting fee for each additional 0.1% of downtime, up to a maximum of 50% of that month's fee.
To claim credit, you must contact us within 30 days of the downtime incident. Credits are applied to future billing and are not redeemable for cash.
To the maximum extent permitted by law, HigherHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
This applies regardless of whether such damages arise from downtime, data loss, security breaches, service interruptions, or any other cause related to our Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us for the Service during the 12 months preceding the claim.
By using our Service, you acknowledge that occasional downtime and service interruptions are inherent risks in any hosting service. You agree to maintain your own backups and implement appropriate safeguards for your business.
You may cancel your account at any time by contacting us at info@higherhost.com. Cancellations take effect at the end of your current billing period. No refunds are provided for partial billing periods (except under our 30-day money-back guarantee).
We may terminate or suspend your account immediately, without prior notice, if you:
Upon termination, your access to the Service will cease. We may delete your data after 30 days following termination. We recommend downloading backups of your website before cancellation.
We reserve the right to modify these Terms at any time. We will notify customers of material changes via email or website notice. Your continued use of the Service after changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
